WHEREAS, Plaintiff and Defendant Energy Corporation of America (“Defendant’) settled this matter on or about August 2016. THEREFORE, IT IS HEREBY STIPULATED by and between Plaintiff and Defendant through their designated counsel that the above-captioned action should be dismissed with prejudice as to Defendant Energy Corporation of America pursuant to FRCP 41(a)(2).
