WHEREAS, Plaintiff no longer wishes to pursue this action in federal court, state court,

IT IS HEREBY STIPULATED, by and between Plaintiff and Defendants, by and through
their respective counsel, that pursuant to Fed. R. Civ. P. 41(a)(1)(A), this action is dismissed
with prejudice. The parties further stipulate that they shall each bear their own attorneys’ fees
