The parties to the action have agreed to a settlement after a settlement conference with

Magistrate Judge Howard R. Lloyd. Dkt. No. 40. Accordingly, this case is DISMISSED WITH
14
PREJUDICE and any scheduled hearings are VACATED. If any party certifies to this Court, with
15
proper notice to opposing counsel within ninety (90) days from the date of this Order, that
16
settlement has not in fact occurred, this Order shall be vacated and the case shall be restored to the
17
calendar for further proceedings.
