IT IS HEREBY STIPULATED by and between Plaintiffs LORI L.

HOLLAND and CHRISTOPHER T. HOLLAND and defendants CALIFORNIA

PHYSICIANS’ SERVICE dba BLUE SHIELD OF CALIFORNIA; BLUE

SHIELD OF CALIFORNIA LIFE & HEALTH INSURANCE COMPANY; and

BLUE CROSS AND BLUE SHIELD ASSOCIATION (collectively, the “Parties”),

through their respective counsel of record, subject to the approval of the Court and
9
pursuant to Federal Rule of Civil Procedure 41(a)(1) and the settlement agreement
10
reached between the Parties that this entire action shall be dismissed with prejudice,
11
and that all Parties shall bear their own attorneys’ fees and costs incurred in
12
connection with this action. This Court shall retain jurisdiction over the Parties and
13
this action for the purpose of enforcing the Parties’ settlement agreement.
