United States District Court Northern District of California 11 12 Pursuant to Rule 16(b) of the Federal Rules of Civil Procedure, the parties attended a Case 13 Management Conference on June 16, 2016. After considering the Joint Case Management 14 Statement submitted by the parties and consulting with the attorneys of record for the parties and 15 good cause appearing, IT IS HEREBY ORDERED THAT: 16 1. DISCOVERY. 17 On or before October 28, 2016, all non-expert discovery shall be completed by the parties. 18 Discovery shall be limited as follows: (a) ten (10) non-expert depositions per party; (b) twenty- 19 five (25) interrogatories per party, including all discrete subparts; (c) a reasonable number of 20 requests for production of documents or for inspection per party; and (d) a reasonable number of 21 requests for admission per party. 22 2. DISCOVERY DISPUTES. 23 Discovery disputes will be referred to a Magistrate Judge. After the parties have met and 24 conferred, the parties shall prepare a joint letter of not more than 5 pages explaining the dispute. 25 Up to 12 pages of attachments may be added. The joint letter must be electronically filed under 26 the Civil Events category of “Motions and Related Filings > Motions--General > Discovery Letter 27 Brief.” The Magistrate Judge to whom the matter is assigned will advise the parties of how that 28 Judge intends to proceed. The Magistrate Judge may issue a ruling, order more formal briefing, or 1 set a telephone conference or a hearing. After a Magistrate Judge has been assigned, all further 2 discovery matters shall be filed pursuant to that Judge’s procedures. 3 3. EXPERT WITNESSES. 4 The disclosure and discovery of expert witnesses shall proceed as follows: a. On or before January 31, 2017, parties will designate experts in accordance with 5 Federal Rule of Civil Procedure 26(a)(2). 6 b. On or before March 7, 2017, all discovery of expert witnesses pursuant to Federal 7 Rule of Civil Procedure 26(b)(4) shall be completed. 8 9 10 4. PRETRIAL MOTIONS. All dispositive pretrial motions must be filed and served pursuant to Civil Local Rule 7. United States District Court Northern District of California 11 Each party is limited to one motion for summary judgment absent leave of Court. All pretrial 12 motions shall be heard no later than December 22, 2016. The Court encourages the participation 13 at oral argument of lawyers who are early in their professional career (e.g., 0-10 years of 14 experience). 15 5. PRETRIAL CONFERENCE. 16 The final pretrial conference will be held on April 13, 2017, at 10:00 a.m., in Courtroom 17 3, 17th Floor, United States Courthouse, 450 Golden Gate Avenue, San Francisco, California. 18 Each party or lead counsel who will try the case shall attend personally. 19 6. 20 A jury trial shall commence on May 1, 2017, at 9:00 a.m., in Courtroom 3, 17th Floor, 21 TRIAL DATE.
