Plaintiff, an inmate at the Public Safety Center in Modesto, California, has filed a pro se
12
civil rights complaint under 42 U.S.C. § 1983 against the Stanislaus County Sheriff’s Department
13
and two of its officers. Stanislaus County is within the venue of the Eastern District of California,
14
and the witnesses apparently would be found in the Eastern District of California as that is the
15
location of the acts or omissions complained of by plaintiff. No defendant is alleged to reside in,
16
and none of the events or omissions giving rise to the complaint occurred in, the Northern District.
17
Venue therefore would be proper in the Eastern District of California, and not in this one. See 28
18
U.S.C. § 1391(b).

Accordingly, in the interest of justice and pursuant to 28 U.S.C. § 1406(a), this action is
20
TRANSFERRED to the United States District Court for the Eastern District of California. In view
21
of the transfer, the Court will not rule upon plaintiff’s pending motion to proceed in forma
22
pauperis (Docket No. 2).

The Clerk shall transfer this matter.
