Pursuant to Fed. R. Civ. P. 16(b)(4) and N.D. Cal. Local Rules 6-2, 7-12, and 16-2(e),
2 Plaintiff William Rushing and Defendants Williams-Sonoma, Inc., Williams-Sonoma DTC, Inc.,
3 Williams-Sonoma Advertising, Inc., Williams-Sonoma Stores, Inc., Pottery Barn, Inc., Pottery
4 Barn Kids, Inc., Pottery Barn Teen, Inc., and West Elm, Inc. (collectively “Defendants”), by and
5 through their respective counsel, stipulate as follows:

RECITALS
1.
WHEREAS, on May 5, 2016, the Court issued an order setting a Case Management
8 Conference for September 6, 2016 at 2:00 p.m. (Dkt. 20);
9
2.
WHEREAS, lead counsel for Defendants has a scheduling conflict that will prevent
10 him from attending the Case Management Conference on September 6, 2016;
11
3.
WHEREAS, the parties have met and conferred, and have agreed to continue the
12 Case Management Conference from September 6, 2016 to September 13, 2016, or the next date
13 upon which the Court is available to conduct the Case Management Conference;
14
4.
WHEREAS, pursuant to Local Rule 6-2(a)(2), all previous time modifications in
15 the case are as follows:

the First Amended Complaint from March 30, 2016 to April 20, 2016;

on May 5, 2016, pursuant to stipulation of the parties, the Court continued the June
21, 2016 Case Management Conference to September 6, 2016; and

on March 29, 2016, the parties stipulated to extend Defendants’ time to respond to
on June 23, 2016, the parties stipulated to extend Defendants’ time to respond to
the Third Amended Complaint from June 23, 2016 to June 27, 2016.

WHEREAS, pursuant to Local Rule 6-2(a)(3), the parties inform the Court that the
23 requested continuance would have no effect on the schedule for the case beyond delaying the Case
24 Management Conference for one week.
