WHEREAS, on April 18, 2016, plaintiff Securities and Exchange Commission

(“Plaintiff”) filed a complaint in the above-captioned action (the “Complaint”) asserting claims

against defendants Erik K. Bardman and Jennifer F. Wolf (“Defendants” and, together with

4

Plaintiff, the “Parties”);

5

WHEREAS, the Court has ordered that the Case Management Conference in this

6

matter is set for November 9, 2016, and the Case Management Statement is due on October 31,

7

2016 (ECF No. 24); and

WHEREAS, due to an unanticipated personal conflict for Mr. Bardman’s counsel on
November 9, 2016, the Parties have agreed, subject to the Court’s approval, to reschedule the Case

Management Conference to November 16, 2016, and have agreed that the Case Management

Statement will be due on November 6, 2016.
