The parties stipulate and respectfully request the Court extend the deadline for filing

Plaintiff’s Reply in Support of its Motion for Partial Summary Judgment until November 28, 2016.

Good cause exists for this request as follows:

1.
The Department of Justice (the “Department”) filed its Reply in Support of its Motion
5
for Partial Summary Judgment and Opposition to Plaintiff’s Cross Motion for Partial Summary
6
Judgment on November 3, 2016.

2.
After reviewing the agency’s brief, Plaintiff contacted the Department by email on
8
November 7, 2016 to discuss narrowing Plaintiff’s request and, thus, further reducing the matters in
9
dispute in this litigation.

3.
By email to Plaintiff on November 11, 2016, the Department represented that it
11
would require additional time to discuss the proposed narrowing, both internally and with other
12
affected government agencies. Thus, the Department did not expect it could provide a full response
13
before the filing of Plaintiff’s Reply brief, currently scheduled for November 17, 2016.

4.
To allow for further discussions between the parties before the filing of Plaintiff’s
Reply, the parties agreed that the deadline for filing should be extended.
Accordingly, the parties respectfully request the Court extend the deadline for the filing of
Plaintiff’s Reply until November 28, 2016.
