Kirk, Rick L. Sterling, and Krish S. Krishnan 2 (collectively, “Defendants”), and Lead Plaintiff Joe Seppen, by and through their attorneys, 3 stipulate and agree as follows: 4 WHEREAS, on August 2, 2016, based on a stipulation by and among the parties, the Court 5 entered an Order Regarding Deadline for Filing Consolidated Amended Complaint and Briefing 6 Schedule for Anticipated Motion(s) to Dismiss (Dkt. No. 41) setting forth a schedule requiring 7 that Plaintiff file its consolidated amended complaint by September 22, 2016, that Defendants 8 answer or otherwise respond by November 17, 2016, that Plaintiff file its opposition to that motion 9 by December 23, 2016, and that Defendants file their reply by February 2, 2017; 10 11 12 13 14 15 WHEREAS, Defendants thereafter timely filed a motion to dismiss the amended complaint in this action (Dkt. No. 46) (“Motion to Dismiss”) on November 17, 2016; WHEREAS, the hearing on Defendants’ Motion to Dismiss is currently noticed for February 16, 2017; WHEREAS, Defendants’ counsel subsequently learned of a scheduling conflict and cannot attend a hearing on February 16, 2017; 16 WHEREAS, Defendants informed Lead Plaintiff of this scheduling conflict and the parties 17 agreed to request that the hearing on Defendants’ Motion to Dismiss be continued for one week to 18 Monday, February 23, 2017. 19 20 21 22 23 24 25 THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and among the respective parties hereto, subject to the approval of the Court, that: 1.
