1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 ALFRED J. ANDERSON, Petitioner, 8 ORDER DISMISSING CASE v. 9 10 SAN MATEO COUNTY JAIL, et al., Respondent. 11 United States District Court Northern District of California Case No.16-cv-02653-JD 12 13 Alfred J. Anderson, a detainee, filed a pro se petition for a writ of habeas corpus pursuant 14 to 28 U.S.C. § 2254. The petition was dismissed with leave to amend. The Court noted that 15 challenges to the conditions of confinement had already been brought in a civil rights action, Case 16 No. 15-cv-3737 JD. To the extent petitioner was challenging his underlying criminal prosecution 17 he was ordered to demonstrate why the Court should interfere in light of Younger v. Harris, 401 18 U.S. 37, 43-54 (1971) (Under principles of comity and federalism, a federal court should not 19 interfere with ongoing state criminal proceedings by granting injunctive or declaratory relief 20 absent extraordinary circumstances. ) Petitioner has not responded or otherwise communicated 21 with the Court. CONCLUSION 22 23 24 25 26 27 28 1. The petition is DISMISSED for failure to respond and for the reasons set forth in the prior order. 2. Because reasonable jurists would not find the result here debatable, a certificate of 1 appealability (“COA”) is DENIED. See Slack v. McDaniel, 529 U.S. 473, 484-85 (2000) 2 (standard for COA). 3 4 IT IS SO ORDERED.
