No. 22 14 15 Before the Court is the “Notice of Motion and Motion for Leave of Court to 16 Withdraw as Counsel of Record,” filed October 19, 2016, by Spinelli, Donald & Nott 17 (“Spinelli”), seeking leave to withdraw as counsel of record for defendant Monument 18 Security, Inc. (“Monument”). 19 “Counsel may not withdraw from an action until relieved by order of Court after 20 written notice has been given reasonably in advance to the client and to all other parties 21 who have appeared in the case.” Civil L.R. 11-5(a). Although Spinelli has submitted a 22 declaration in which it implies the instant motion was served on Monument by mail on or 23 about the date such motion was filed, (see Nott Dec. ¶ 6 (“I have confirmed the address 24 to which this notice has been sent is . . . current . . . .”)), the declaration contains no 25 definitive statement to that effect. 26 27 28 Accordingly, Spinelli is hereby DIRECTED to file, no later than October 28, 2016, 1 proof of service of the above-referenced motion on Monument.1 2 3 IT IS SO ORDERED. 4 5 Dated: October 24, 2016 MAXINE M.
