Pursuant to 16 plaintiff’s notice of voluntary dismissal (Docket No. 18) under Rule 41(a) of the Federal Rules of 17 Civil Procedure, this case is DISMISSED without prejudice. The Clerk shall close the file and terminate all pending motions (Docket Nos. 16, 17) as 18 19 20 21 moot. IT IS SO ORDERED.
