IT IS HEREBY STIPULATED by and between Plaintiff STEVE EVERSON and Defendants

FIRST TRANSIT, INC., NINA JOHNSTON, PEDRO CARBALLO, and DOUG MONTEZ, by and

through their respective attorneys of record, that pursuant to Federal Rules of Civil Procedure
4
41(a)(1)(A)(ii) the above referenced action be DISMISSED WITH PREJUDICE in its entirety.

The parties further stipulate that each party shall bear his, her, or its own costs, including attorneys’
6
fees.

IT IS FURTHER STIPULATED that: the Court shall retain jurisdiction of this matter to
8
enforce the parties’ settlement agreement, the terms of which are expressly incorporated by reference

into this stipulation and order.
