TO THE COURT, PLAINTIFF, AND HIS ATTORNEY OF RECORD:

Plaintiff Steven Dransfield ("Plaintiff') and Defendant Ross Stores, Inc.
3 ("Defendant" or "Ross") (individually "Party," and collectively "Parties"), both jointly
4 request and herby stipulate, through their undersigned counsel, as follows:
WHEREAS, Plaintiff initially filed a complaint before this Court on August 15,

2016;
WHEREAS, after filing of the complaint, the Parlies agreed to submit this matter to
7
8 mediation and arbitration, pursuant to a Dispute Resolution Agreement ("DRA") between
9 them;
10
WHEREAS, pursuant to the Parties' agreement, the Court stayed the instant
1 1 proceedings, ordered the matter to resolution through the Parties' DRA, and scheduled a
12 Case Management Conference ("CMC") for February 9, 2017 to follow up on the status of
13 the proceeding;
14
WHEREAS, the Parties have agreed to participate in a private mediation session
15 with Jeffrey A. Ross on February 9, 2017, the first available date that satisfies Mr. Ross'
16 calendar and those of the Parties;
17
WHEREAS, given the status of this matter, it would be difficult to reschedule the
18 private mediation session; and
19
WHEREAS, the Parties' agree that a continuance of the CMC would be appropriate
20 while they seek informal resolution at mediation;
21
NOW THEREFORE, the Parties respectfully stipulate to and request that this
22 Court enter an order continuing the February 9, 2017 CMC for sixty (60) days, or a date as
23 soon thereafter that is convenient for the Court.
