On June 29, 2017, this Court ordered Plaintiff’s counsel to file, by July 10, a

13

declaration that he sent a copy of that order to his client. Counsel failed to do so, but he

14

did file the required declaration on July 25, 2017 – fifteen days late. The Court also

15

ordered the parties to file a joint case management conference statement on or before

16

July 24. The parties instead filed separate statements, despite the efforts to meet and

17

confer described by Defendants’ counsel in her declaration.

18

Although Plaintiff’s counsel’s personal difficulties are interfering with his ability to

19

represent Plaintiff in this case, the Court does not at this time find good cause to dismiss

20

the case for failure to prosecute. However, it encourages counsel to continue seeking

21

co-counsel or substitute counsel to assist with the prosecution of this case.

22

The parties are advised that the undersigned will soon be assuming inactive status,

23

and that this case will be reassigned to another judge on or around August 14, 2017. The

24

Court finds it prudent to continue the July 31, 2017 case management conference to leave

25

maximum discretion in how to manage this case to the newly assigned judge.

26

Accordingly, IT IS HEREBY ORDERED that the July 31, 2017 case management

27

conference is CONTINUED to August 28, 2017, at 1:30 PM. If any updates to the

28

parties’ July 24 statements are appropriate, the parties shall file a joint statement on or

before August 21, 2017. The newly assigned judge may, in his or her discretion, alter one

2

or both of these dates.
