On March 10, 2017, defendant moved to dismiss plaintiff’s first amended complaint, with

14

a hearing date of April 19, 2017. Dkt. No. 38. Plaintiff’s response was due on March 24, 2017.

She did not appear at the hearing on defendant’s motion to dismiss her original complaint, and she

16

has yet to file a response to the pending motion. Ms. Alvarez is ORDERED to respond to

17

defendant’s motion by April 19, 2017; defendant’s reply will be due April 26, 2017. The hearing

18

is reset to May 3, 2017.

If she fails to respond by April 19, 2017, defendant’s motion will be granted, and only her

20

claims under the Homeowner’s Bill of Rights and California Civil Code section 2923.5 will

21

proceed.
