Plaintiff was sent a notice that he 14 had not paid the filing fee or applied for leave to proceed in forma pauperis (“IFP”). He was 15 allowed twenty-eight days to either pay the fee or file a proper application. More than twenty- 16 eight days has passed and plaintiff has not filed an IFP application, paid the filing fee or otherwise 17 communicated with the Court. Therefore, this case is DISMISSED without prejudice. Plaintiff’s 18 motion for a temporary restraining order (Docket No. 2) is DENIED. 19 20 IT IS SO ORDERED.
