1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 ALLCELLS, LLC, Plaintiff, 8 ORDER GRANTING IN PART PLAINTIFF’S ADMINISTRATIVE MOTION TO FILE UNDER SEAL 9 v. 10 JACK ZHAI, et al., Docket Nos. 81, 88 Defendants. 12 For the Northern District of California United States District Court 11 Case No. 16-cv-07323-EMC 13 Previously, the Court granted in part, denied in part, and deferred in part AllCells’s motion 14 to file under seal. See Docket No. 81 (motion); Docket No. 88 (order). The Court deferred ruling 15 with respect to Exhibits B and I attached to the Weil reply declaration, as well as Exhibit 1 to the 16 Pixley reply declaration. AllCells has submitted a declaration from Mr. Tong to support its claim 17 of confidentiality with respect to these exhibits. See Docket No. 97 (Tong declaration). 18 The Court grants the motion to seal Exhibit I. 19 As for Exhibits B and 1, while the Court is skeptical that the documents contain 20 confidential information in need of sealing, the Court shall, out of an abundance of caution, grant 21 the motion to file under seal without prejudice. 22 23 As with its prior orders, the Court notes that, in granting the motion to file under seal, it is not making any ruling as to whether any information is a trade secret. 24 This order disposes of Docket No. 81. 25 IT IS SO ORDERED. 26 27 28 Dated: March 28, 2017 ______________________________________ EDWARD M.
