WHEREAS, the Court noticed a Motion Hearing for August 3, 2017 at 9:30 am as to

WHEREAS, the Court noticed a Motion Hearing for September 12, 2017 at 2:00 pm as to
Plaintiffs’ Motion to Dismiss Plaintiff’s Patent Infringement Claims and Related Counterclaims
(dkt. Nos. 79, 80);
WHEAREAS, counsel for Plaintiffs/Counter-defendants has a recently developed conflict
with the August 3 hearing;
WHEREAS, there are issues that overlap with respect to Plaintiff’s Motion to Dismiss
Plaintiff’s Patent Infringement Claims and Related Counterclaims (dkt. No. 79) and Plaintiffs’
Motion to Strike Answer to Amended Complaint (dkt No. 70) and Plaintiffs’ Motion to Dismiss

Defendants’ Counterclaims (dkt. Nos. 72-73), and a ruling as to one motion could affect the

Court’s evaluation of another motion;

WHEREAS, the Parties have stipulated to combine the Motion Hearings into one Motion
Hearing on September 12, 2017 at 2:00 pm;
WHEREAS, the Parties would be available at an earlier date, subject to the Court’s
7
calendar, but the Parties understand (from the Court’s calendar online) that the following earlier
8
dates are not currently available: August 31 or Sept 7;

WHEREAS, the Parties have stipulated to three previous time modifications in connection
with responses to the Parties’ pleadings on April 11, 2017 (dkt. No. 35) and May 18, 2017 (dkt.
No. 51), and June 14, 2017 (dkt. No. 68);
WHEREAS, this stipulation will not alter the date of any event or any deadline already
fixed by Court order.
WHEREAS, this stipulation will alter the date of the Motions Hearing on August 3, 2017
at 9:30 am.

NOW, THEREFORE, the Parties, by and through their respective counsel, hereby

stipulate and agree that the Motion Hearing on August 3, 2017 at 9:30 and the Motion Hearing on
