Defendant Ukiah Car Center, LLC (hereinafter “UCC”) and Defendant HTR Properties

(hereinafter “HTR”) by and through their respective counsel, do hereby stipulate to the following:

1) On June 2, 2017, HTR filed a motion to dismiss UCC’s cross claim (Dkt. 31);

23

2) The motion hearing date is currently set for July 19, 2017, at 2:00 p.m.;

24

3) On June 9, 2017, UCC filed a notice of unavailability for July 13, 2017, through July

25

27, 2017 (Dkt. 33);

4 ) On June 26, 2017, Defendant UCC filed a Stipulation to move the hearing date to

27

August 2, 2017 (Dkt. 41), however, Defendant UCC inadvertently picked a date of August 2,

2017, as Honorable William H. Orrick will unavailable through August 4, 2017; and

5) The Parties have met and conferred and agreed on a mutually-convenient date for the
motion hearing;
6) Therefore, the Parties respectfully request that the Court continue the date of the motion
