1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 ANDRE JUSTE, Plaintiff, 8 9 10 ORDER ON PAUPER APPLICATION v. Re: Dkt. No. 5 STATE OF NEW YORK, et al., Defendants. 11 United States District Court Northern District of California Case No. 17-cv-01287-SI 12 13 14 Plaintiff’s application to proceed in forma pauperis in the district court is GRANTED. (Docket No. 5.) 15 This action recently was dismissed because it was filed in the wrong venue. The court 16 chose dismissal rather than transfer because plaintiff has filed more than seventy actions 17 throughout the country but chooses not to comply with venue requirements of which he is aware. 18 Although the court has permitted plaintiff to file his action in the district court as a pauper, the 19 court now certifies that an appeal from the order of dismissal would not be taken in good faith. 20 See 28 U.S.C. § 1915(a)(3). 21 22 23 24 25 26 27 28 IT IS SO ORDERED. Dated: April 11, 2017 ______________________________________ SUSAN ILLSTON United States District Judge
