STIPULATION
WHEREAS on March 16, 2017 Plaintiff Satenick Dolunts Otto (“Plaintiff”) brought
3 suit in this action against defendant Bank of the West (the “Bank”) alleging violations of
4 the Fair Labor Standards Act (“FLSA”); and
5
WHEREAS on December 22, 2017 Plaintiff and the Bank settled Plaintiff’s
6 individual FLSA claims, and on or around January 8, 2018 executed a Settlement
7 Agreement and General Release (“Settlement Agreement”);
8
THEREFORE, IT IS HEREBY STIPULATED between Plaintiff and the Bank
9 through their counsel that this action shall be dismissed with prejudice pursuant to
10 Federal Rule of Civil Procedure 41(a)(1)(A)(ii). Plaintiff and the Bank further stipulate
11 that, except as set forth in the Settlement Agreement, each party shall bear her or its own
12 attorneys’ fees and costs.
