1 2 3 4 5 6 IN THE UNITED STATES DISTRICT COURT 7 FOR THE NORTHERN DISTRICT OF CALIFORNIA 8 9 11 For the Northern District of California United States District Court 10 ROBERT BENSON, individually and on behalf of all others similarly situated, Plaintiff, 12 13 14 15 No. C 17-01894 WHA v. ORDER DENYING ADMINISTRATIVE MOTION TO STAY PROCEEDINGS HARRISON GLOBAL, LLC, dba BOSTON COACH, Defendant. / 16 17 Defendant’s administrative motion to stay proceedings (Dkt. No. 31) is DENIED, 18 principally for the reasons set forth in plaintiff’s opposition thereto (Dkt. No. 34). In the event 19 that Huddlestun is resolved on a class-wide basis in such a way as to eliminate some part of the 20 instant putative class action, a new motion to limit the proceedings herein may be entertained. 21 The Court also takes note of plaintiff’s counsel’s suspicion that movant and the plaintiff’s 22 counsel in Huddlestun are drawing up a collusive settlement based on inadequate discovery (see 23 id. at 1, 4). Possibly this is true. If it so develops, plaintiff’s counsel will have the opportunity 24 to present their arguments on the issue to Judge Sabraw. 25 26 IT IS SO ORDERED. 27 28 Dated: August 16, 2017. WILLIAM ALSUP UNITED STATES DISTRICT JUDGE
