Pursuant to N.D. Cal. Civil Local Rule 6-2, Plaintiff Brendan Peacock (“Plaintiff”), and

Defendant, The 21st Amendment Brewery Cafe, LLC (“Defendant”), through their respective

counsel, hereby stipulate and agree as follows:

Whereas the parties stipulated to participate in mediation, which the Court ordered on
August 14, 2017.
Whereas the current deadline to complete Alternative Dispute Resolution is November
13, 2017.

Whereas the case management conference scheduled for November 2, 2017 was

continued to January 17, 2017 and the hearing on defendant’s motion to dismiss scheduled for

November 2, 2017 was vacated.
Whereas, the parties believe that mediation would be more fruitful were it to occur after
resolution of Defendant’s pending motion to dismiss.

Therefore, the parties stipulate and respectfully request an extension of 90 days of the
14
deadline for the parties to complete mediation up to and including February 12, 2017. 2018
