WHEREAS, the hearing on Defendants’ Motion to Partially Compel Arbitration, Strike
3 Class Action Claims, and Stay Proceedings (Dkt. No. 22) (“Motion”) is presently on calendar for
4 August 17, 2017, at 8:00 a.m.;
5
WHEREAS, the Court recently scheduled a Case Management Conference for August 17,
6 2017, at 11:00 a.m. (Dkt. No. 42);
7
WHEREAS, the attorney who will argue the Motion on behalf of Plaintiffs (Michael
8 Rubin) will be out of state on a long-planned family vacation on August 17, 2017. For that reason,
9 Plaintiffs’ counsel has requested that Defendants’ counsel agree to continue the hearing date for
10 the Motion; and
11
WHEREAS, in consideration of the schedule of the attorney who will argue the Motion on
12 behalf of Defendants, and in view of the Court’s calendar, the parties have agreed that a three13 week continuance of the hearing date for the Motion and for the Case Management Conference
14 would be appropriate, such that both events would be scheduled for September 7, 2017;
15
NOW, THEREFORE, through their respective counsel, subject to Court approval,
16 Plaintiffs and Defendants hereby stipulate and agree that the hearing on the Motion should be
17 continued to September 7, 2017, at 8:00 a.m., and that the Case Management Conference should

18 be continued to September 7, 2017 at 11:00 a.m.
