Petitioner has not complied with the Court’s order to (1) perfect his application to

United States District Court
Northern District of California

proceed in forma pauperis (“IFP”), or (2) pay the full filing fee of $5.00. His IFP
12
application is incomplete because he did not file the IFP application form, though he did
13
file a prison trust account statement and a Certificate of Funds. Accordingly, the action is
14
DISMISSED without prejudice for failing to respond to the Court’s order, and for failure
15
to prosecute, see Fed. R. Civ. P. 41(b).1
Because this dismissal is without prejudice, petitioner may move to reopen the
16
17
action. Any such motion must contain (1) a properly completed and signed IFP
18
application form, or (2) full payment for the $5.00 filing fee.
19
The Clerk shall enter judgment in favor of respondent, and close the file.
