IT IS HEREBY STIPULATED by and between the parties through their undersigned

counsel that, pursuant to Rule 41 (a) (2) of the Federal Rules of Civil Procedure and the full

and final settlement of the entire case, in view of receipt of the settlement proceeds from all
23
Defendants except for Defendant P.G.&E. Corp., 1 the above-captioned action, including all
24
claims, cross-claims, cross-complaints, and counterclaims brought therein, is dismissed with
25
prejudice, each party to bear its own costs and fees.

Pursuant to a separate settlement agreement, the Bankruptcy Court retains jurisdiction over the
Plaintiff and Defendant P.G. & E. Corp. with respect to any matters related to or arising from that
aspect of the global settlement of this action.
