1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 ARLENE BROWN, Case No. 17-cv-05531-EMC Plaintiff, 8 ORDER OF DISMISSAL v. 9 Docket No. 24 LION SHARE INVESTMENTS, LLC, 11 Defendant. 12 For the Northern District of California United States District Court 10 13 Previously, the Court issued to Ms. Brown an order to show cause as to why her 14 bankruptcy appeal before this Court (i.e., of the bankruptcy court’s order of September 8, 2017, 15 granting Lion Share’s motion for relief from the bankruptcy automatic stay) should not be 16 dismissed based on his failure to prosecute the appeal and/or the dismissal of the underlying 17 bankruptcy case. The Court instructed Ms. Brown to file a response to the order to show cause by 18 February 7, 2018, and specifically warned Ms. Brown that, if she failed to file a response by that 19 date, her appeal before this Court would be automatically dismissed. See Docket No. 24 (order to 20 show cause). It is now past February 7, and the Court still has received no response to the order to show 21 22 cause. Accordingly, the Court hereby DISMISSES Ms. Brown’s appeal based on her failure to 23 /// 24 /// 25 /// 26 /// 27 /// 28 /// 1 prosecute, the dismissal of the underlying bankruptcy case, and her failure to respond to the order 2 to show cause.
