Pursuant to Civ. L.R. 6-2, Plaintiff Automated Packaging Systems, Inc. (“Automated”)

and Defendant Free-Flow Packaging International, Inc. (“FPI”) (collectively, the “Parties”)

submit this STIPULATION AND [PROPOSED] ORDER for the Court’s approval;

WHEREAS, on January 16, 2018, the United States District Court for the Northern

5

District of Ohio transferred this case to the United States District Court for the Northern District

6

of California;

WHEREAS, on January 17, 2018, this case was assigned to the Honorable Sallie Kim
and an Initial Case Management Conference was set for April 30, 2018 (Dkt. No. 108);

WHEREAS, on February 1, 2018, this case was reassigned to the Honorable Edward M.
Chen (Dkt. No. 122);

WHEREAS, on February 13, 2018, the Court set a Case Management Conference for
March 29, 2018 (Dkt. No. 139);

WHEREAS, lead trial counsel for FPI, who is required to appear at the Case

Management Conference pursuant to Civ. L.R. 16-10(a) and wishes to do so, is unavailable on

March 29, 2018;

WHEREAS, the Parties have met and conferred regarding a stipulated request to continue
the Initial Case Management Conference;

IT IS HEREBY STIPULATED that (a) the Initial Case Management Conference be

continued from March 29, 2018 to April 19, 20181 and (b) the Parties will submit a Joint Case

Management Statement pursuant to Civ. L.R. 16-9(a) on or before April 12, 2018.

The Parties’ Stipulation will not affect any other deadline set by the Court or otherwise
impact the case schedule.
