Plaintiff has not complied with the Court’s order to file an amended complaint by

16

the deadline. Accordingly, this federal civil rights action is DISMISSED (without

17

prejudice) for plaintiff’s failure to comply with the Court’s order and for failure to

18

prosecute, see Federal Rule of Civil Procedure 41(b).

19

Because this dismissal is without prejudice, plaintiff may move to reopen the action.

20

Any such motion must contain an amended complaint that complies in all respects with the

21

Court’s order dismissing the original complaint with leave to amend. (Dkt. No. 5.) The

22

Clerk shall enter judgment in favor of defendants, and close the file.
