Plaintiff advises the Court that the parties have reached a settlement of this case and that 13 Plaintiff expects to file a dismissal with prejudice within thirty days. (Dkt. 26.) Therefore, IT IS 14 HEREBY ORDERED that this cause of action is dismissed without prejudice; provided, 15 however that if any party hereto shall certify to this Court, within thirty days, with proof of service 16 thereof, that the agreed consideration for said settlement has not been delivered over, the foregoing 17 order shall stand vacated and this cause shall forthwith be restored to the calendar to be set for 18 trial. If no certification is filed, after passage of thirty days, the dismissal shall be with prejudice. 19 20 21 22 23 24 25 26 27 28 IT IS SO ORDERED.
