1 2 3 4 5 IN THE UNITED STATES DISTRICT COURT 6 FOR THE NORTHERN DISTRICT OF CALIFORNIA 7 8 CHIA NETWORK INC., Plaintiff, 9 United States District Court Northern District of California 10 Case No. 24-cv-07734-CRB ORDER TO SHOW CAUSE v. 11 DATA VAULT HOLDINGS, INC., 12 Defendant. 13 Plaintiff Chia Network Inc. brought this lawsuit in California state court against 14 Defendant Data Vault Holdings, Inc. alleging breach of contract, common counts, and 15 fraud. See Compl. (dkt. 2). Data Vault removed the case to federal court. See Notice of 16 Removal (dkt. 1). Data Vault then filed a motion to dismiss on December 12, 2024. See 17 MTD (dkt. 12). Chia Network’s opposition to Data Vault’s motion was due on December 18 26, 2024, but it has failed to file any opposition. Accordingly, the Court ORDERS CHIA 19 NETWORK TO SHOW CAUSE BY JANUARY 17, 2024 why this case should not be 20 terminated for failure to prosecute under Federal Rule of Civil Procedure 41(b). Failure to 21 respond will result in dismissal of this action with prejudice. 22 All hearing dates and remaining deadlines associated with Data Vault’s motion to 23 dismiss are vacated pending a response to this Order. The Clerk of Court is instructed to 24 send a copy of this Order to Chia Network’s counsel by priority mail. 25 IT IS SO ORDERED. 26 Dated: January 7, 2025 27 28 CHARLES R.
