WHEREAS, on June 8, 2009, this Court issued its Order Denying Defendant's Motion

18 for Judgment as a Matter of Law, pursuant to which this Court directed the parties "to attend 19 further private mediation with the same mediator that conducted the previous mediation" by 20 September 6, 2009. [D.E. 2033 at p. 17.] 21 WHEREAS, the parties have since discussed a range of options for proceeding with

22 mediation in the most productive manner while complying with this Court's order. 23 24 2009. 25 WHEREAS, trial will commence on November 1, 2010, twelve months and one day after WHEREAS, the parties jointly request that the mediation date be extended to October 31,

26 a mediation date of October 31, 2009. [D.E. 2035.] 27 WHEREAS, it would be in the best interests of the parties for mediation to occur by
