1 2 3 4 UNITED STATES DISTRICT COURT 5 NORTHERN DISTRICT OF CALIFORNIA 6 7 MARTHA BERNDT, et al., 9 10 11 Case No. 03-cv-3174-PJH Plaintiffs, 8 v. ORDER RE TELEPHONIC STATUS CONFERENCE CALIFORNIA DEPARTMENT OF CORRECTIONS, et al., United States District Court Northern District of California Defendants. 12 13 14 On July 10, 2015, at the request of the parties in the above-captioned case, the 15 court held a telephonic status conference. Plaintiffs requested that the pretrial and trial 16 schedule be modified, in light of the fact that five of the seven plaintiffs have reached 17 settlements in principle. Specifically, plaintiffs requested the following: (1) a continuance 18 of the pretrial conference, from August 17, 2015 to August 31, 2015; (2) a continuance of 19 the trial start date, from September 14, 2015 to September 28, 2015; and (3) a total of 20 four weeks for trial. Defendants did not object to the continuance of the pretrial 21 conference and the trial start date, but opposed the request for four weeks of trial. 22 Defendants argued that the court had allotted seven weeks for trial when the case 23 involved seven plaintiffs, and thus argued that only two weeks should be allotted for the 24 remaining two plaintiffs. 25 As stated at the conference, the request to continue the pretrial conference and 26 the trial start date is denied, as those dates have been set since October 20, 2014, and 27 the court is unavailable on the requested pretrial conference date. Thus, the pretrial 28 conference shall remain as scheduled on August 17, 2015, and the trial start date shall 1 2 rem main as sch heduled on September 14, 2015. See Dkt. 752. As to the trial leng the cou will allot three week for trial, b will exc gth, urt ks but clude any 3 tim spent on jury select me n tion, closing argument jury instr g ts, ructions, an deliberat nd tions. 4 Thus, in effec the partie will have approxima ct, es e ately three-and-one-ha weeks fo trial. As alf or 5 sta ated in the pretrial orde the cour trial sch p er, rt’s hedule is 8:3 a.m. to 1 30 1:30 p.m., w two with 6 fifte een-minute breaks, on Monday, Tuesday, T e n T Thursday, a Friday.
