above-referenced cases.
4
he intends to retire on December 31, 2013.
5
the exceptional amount of judicial resources expended adjudicating

disputes in this case nevertheless continues to warrant the

8
justifies the expansion of his duties to assist in pre-trial
9
matters, such as in limine motions.
Judge Legge has informed the Court that
The Court finds that
The Court will appoint one of

13
including law clerks made available by the parties and retained

through JAMS, shall continue to be available to the replacement
15
special master.
16
Any resources provided to Judge Legge,
Pursuant to Federal Rule of Civil Procedure 53(b)(1), the

Court provides the parties with notice and an opportunity to be

heard on this issue.
19
their choice of a special master from the three candidates
20
referenced above.
21
they shall each submit their rankings of preferred candidates in a
22
confidential letter to the Court and the Court will select one.
23
Any stipulation or letter shall be submitted no later than
24
December 13, 2013.
25
The parties are encouraged to stipulate to
If the parties cannot come to an agreement,
The Court also seeks the parties’ stipulation that the
26
standard of review applicable to pretrial matters decided by
27
magistrate judges set out in 28 U.S.C. § 636(b)(1)(A) shall apply
28
to the special master’s orders in this case.

If the parties
1
agree, they shall file a stipulation at the same time as their
2
responses to this notice.
