On or about April 16, 2009, the United States Court of Appeals for the Ninth Circuit denied the petition for rehearing en banc in the Metro Lights case. 2. Metro Fuel (which is the successor in interest to Metro Lights) intends to petition the United States Supreme Court for certiorari in the Metro Lights case. Metro Fuel's petition is due to be filed in mid-July 2009. The parties expect that the United States Supreme Court will act on the petition in October 2009. 3. The parties hereby jointly recommend and request that the Case Management Conference presently scheduled for April 30, 2009 be continued until November 12, 2009 at 2:30 p.m., with a Joint Case Management Statement to be filed on or before October 29, 2009. The parties request that the Court vacate March 19, 2008 Order Scheduling Trial And Pretrial Matters. 4.
