C-08-04144 SBA 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Dated: Pursuant to Local Rule 7-13, Defendant Netlist, Inc. hereby provides this notice regarding its pending Administrative Motion to File Notice of Motion and Motion for Summary Judgment of Patent Infringement and Related Exhibits Under Seal. The pending administrative motion to file under seal was filed with the Court on June 1, 2010 [Docket No. 138]. Netlist served Google with its Motion for Summary Judgment on that date and lodged it with the Court on June 2, 2010. The Court has already granted a separate administrative motion to file Netlist's motion for summary judgment on Google's affirmative defenses under seal; however, the Court has not yet ruled on Netlist's administrative motion to file its motion for summary judgment of patent infringement under seal. Netlist requested that its Motion for Summary Judgment of Patent Infringement and Related Exhibits be filed under seal because they contain information designated by Google and third parties as Protected Information under the terms of the Second Amended Protective Order. Google has not opposed Netlist's administrative motion to seal nor has Google filed a declaration within 7 days under Local Rule 79-5(d). Accordingly, Netlist respectfully requests a ruling on its pending administrative motion so that it may proceed with the filing of its Motion for Summary Judgment of Patent Infringement and Related Exhibits.
