This Court has review Plaintiff Google Inc.'s ("Google") Motion for Summary Judgment of Invaldity; Netlist, Inc.'s ("Netlist") Opposition thereto; the declarations and other evidence submitted in support of and in opposition to that motion; and heard arguments of counsel. The Court finds that claims 1 and 11 of United States Patent No. 7,289,386 are invalid for failing to comply with the written description requirement of 35 U.S.C. § 112(1). Accordingly, the Court hereby GRANTS Plaintiff Google Inc.s Motion for Summary Judgment of Invalidity in its entirety.
