WHEREAS: A. The parties have agreed to participate in an early mediation before Magistrate

Judge Spero on April 1, 2009 (and possibly April 2, 2009, if necessary), and this Court approved the parties' stipulation on March 9, 2009; and B. C. Plaintiffs filed an Amended Complaint on March 2, 2009; and The initial Case Management Conference in this case is currently set for

March 24, 2009, before the scheduled mediation. It is HEREBY STIPULATED AND AGREED by and between Plaintiffs Grady Jackson and Kelley Alexander ("Plaintiffs") and Defendants Balanced Health Products, Inc., Nikki Haskell, General Nutrition Corporation, General Nutrition Centers, Inc., and The Vitamin Shoppe Industries, Inc. (collectively, "Defendants"), through their respective counsel, as follows: 1. The deadline for Defendants to answer or otherwise respond to Plaintiffs'
