WHEREAS, in an attempt to reach a resolution in this action, the parties have agreed to mediate this matter before Mark Rudy and scheduled the mediation for November 19, 2010, one of the agreed-upon mediator's first available dates. WHEREAS, the parties believe that, in the interests of efficiency and of avoiding potentially unnecessary expenses, the Case Management Conference, to the extent one is necessary, should be continued until Tuesday, December 7, 2010 at 2:00 p.m. IT IS HEREBY STIPULATED by and between the parties, through their respective counsel: 1. The Case Management Conference is hereby continued until Tuesday, December 7, 2010 at 2:00 p.m. 2. The parties must file an updated Joint Case Management Statement at least seven (7) days before the Case Management Conference.
