Plaintiff, who is currently incarcerated at Santa Rita Jail, filed the instant action

18

pursuant to 42 U.S.C. § 1983. On November 10, 2010, the Court ordered service of the

19

Complaint and directed Defendants to file a motion for summary judgment. Dkt. 8.

20

Defendants filed their motion as directed by the Court and the motion is now fully briefed.

21

The Court, in its discretion, finds this matter suitable for resolution without oral argument.

22

Fed. R. Civ. P. 78(b); N.D. Cal. Civ. L.R. 7-1(b). Accordingly,

23

IT IS HEREBY ORDERED THAT the hearing on Defendants’ motion for summary

24

judgment scheduled for December 6, 2011 is VACATED. The Court will resolve the

25

motion in a separate order.
