T h e court has scheduled a Case Management Conference for September 1 7 , 2009 in the above-captioned case. 2. T h e parties agree that the Case Management Conference should be c o n tin u e d in light of the following: a. A t the August 19, 2009 hearing on plaintiffs' motion for p relim in ary injunction and defendant Maxwell-Jolly's motion to dismiss, the Court s ta ye d the parties' discovery obligations under Rule 26. b. O n August 19, 2009 and September 1, 2009, the court entered o rd e rs (1) denying plaintiffs' motion for preliminary injunction; (2) granting defendant M a x w e ll-J o lly's motion to dismiss the complaint under Federal Rule 12(b)(6), and (3) g ra n tin g defendants Schwarzenegger's and Lockyer's motion to dismiss under Federal R u le 12(b)(1). c. O n September 1, 2009, plaintiffs appealed the court's orders d e n yin g plaintiffs' motion for preliminary injunction and granting defendant MaxwellJ o lly's motion to dismiss the complaint under Federal Rule 12(b)(6).
