ORDER
Pursuant to the stipulation of the parties and good cause appearing therefore, 1. Plaintiff shall file a Second Amended Complaint on or before November 23, 2009, or risk dismissal for failure to prosecute. 2. Plaintiff's filing of a Second Amended Complaint on or before November 23, 2009 shall render all currently pending motions to dismiss and/or to strike, moot. Any responsive pleading, motion to dismiss, or motion to strike Plaintiff's proposed Second Amended Complaint or portions thereof shall be due within 23 days of the filing of the Second Amended Complaint.
