CV 09-04668 CW 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, on October 19, 2009, the Court preliminarily enjoined Defendants from implementing the provisions of ABX4 4 that amended Sections 12309(e) and 12309.2 of the California Welfare and Institutions Code to terminate from eligibility for IHSS services those recipients with Functional Index Scores of less than 2.0 and to eliminate domestic and related services for recipients with functional ranks of less than 4 for those services; WHEREAS, the parties agreed to work jointly on a form of notice to be sent to potentially affected recipients, informing them of this Court's preliminary injunction, and that their IHSS services would not be terminated or reduced as provided in ABX4 4; WHEREAS, the parties agree that Defendants shall mail via First Class mail a Notice in the form attached hereto as Exhibit A to recipients whose IHSS services would have been terminated or reduced by operation of ABX4 4; WHEREAS, the parties agree that Defendants shall begin mailing the Notice to Recipients on October 27, 2009 and mail out all such Notices no later than October 29, 2009; WHEREAS, the parties agree that the Notice shall be printed in Arial 14 point font, which maximizes readability for recipients with vision impairments; WHEREAS, the parties agree that Defendants shall translate the Notice into Spanish, Russian, Armenian, Vietnamese, and Chinese; WHEREAS, the parties agree that the Notice will not be in the standard Notice of Action ("NOA") format generally used to communicate changes in services to IHSS recipients; WHEREAS, the parties agree that Defendants shall include with the Notice a notification of free translation services, in the form attached hereto as Exhibit B; /// /// /// /// /// /// STIPULATION AND ORDER RE NOTICE CASE NO.
