On March 25, 2013, the Court granted in part and denied in part Plaintiff's motion
15
for leave to file an amended complaint. Dkt. 49. On April 1, 2013, Plaintiff filed a first
16
amended complaint. Accordingly, Defendant's motion for judgment on the pleadings (Dkt.
17
25) is DENIED as MOOT. Plaintiff's motion for leave to file a surreply to Defendant's
18
motion for judgment on the pleadings is also DENIED as MOOT. This Order terminates
19
Docket 25 and Docket 40.

IT IS SO ORDERED.
