It appears that current counsel for Federal Defendants are prepared to file a motion to dismiss Plaintiffs' First Amended Dockets.Justia.com 1 2 3 4 5 6 7 8 9 10 United States District Court For the Northern District of California 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Complaint on May 2, 2011. on May 16, 2011. Plaintiffs shall file their opposition Defendants' reply would be due on May 23, 2011, but if Defendants require an extension of that deadline, they may request one at that time. Meanwhile, written discovery may be taken from Plaintiffs and the State Defendants, and document production requests may be made of the Federal Defendants. other discovery is stayed until May 9, 2011. Plaintiffs may file their motion for class certification, as scheduled, on April 14, 2011 if they are able to do so. If All Plaintiffs move for class certification then, and Federal Defendants are in need of an extension of time for their response, they may request one at that time. If Plaintiffs are unable to file their motion on April 14, 2011 due to the partial stay of discovery, they may attempt to agree upon a new briefing and hearing schedule with Federal Defendants at that time, or file an administrative motion proposing a new schedule.
