ORDER GRANTING DEFENDANTS' REVISED BILL OF COSTS STATEMENT: The court previously issued its order resolving the disputes about the costs bills and taxing costs for 5 of the 10 defendants. (See 9/4/15 Order, ECF No. 1462 at 12.) The court el iminated costs attributable to the Atheros depositions for five computer defendants and directed them to submit their revised costs that identified and subtracted the Atheros costs. They did so, and the court now issues the attached order taxing the costs for the remaining five defendants. USEI previously moved to stay execution of costs (or a ruling that it may post a bond of 50% or less). (See id. at 11.) The reason in part was that in the Eastern District of Texas, a jury found two of th e four accused patents in this case not invalid. (Id.) As discussed at the hearing, and with the agreement of the parties, the court denied the motion without prejudice to USEIs raising it before the trial judge. As the court previously ordered, USEI must file its motion no later than two weeks from the date of this order.
