WHEREAS at the September 28, 2011 Markman hearing, Honorable Phyllis J. Hamilton

ordered that Defendants Hewlett-Packard Company (“HP”) and International Business Machines

Corp. (“IBM”) and Plaintiff BackWeb Technologies, Ltd. (“BackWeb”) (collectively “the
11
Parties”) meet and confer in order to determine whether any compromises regarding the Parties’
12
proposed claim constructions could be made;
WHEREAS Honorable Phyllis J. Hamilton ordered that the Parties submit a letter detailing
13
14
any compromises reached by the Parties by Wednesday October 5, 2011;
WHEREAS the Parties are currently in the process of meeting and conferring regarding
15
16
whether any compromises can be made in order to conserve judicial resources;
WHEREAS the Parties believe that they will need until Friday October 14, 2011 to
17

complete the meet and confer process in a meaningful manner;
NOW THEREFORE the parties hereby request the Court extend the deadline for
19

submitting the Parties’ statement on any claim construction compromises until Friday October 14,
21
2011.
