MARIO TRUJILLO,

Plaintiff,
vs.

FRANCISCO JACQUEZ, et al.,
Case No. 10-cv-5183 YGR
ORDER STRIKING MOTION FOR SUMMARY
JUDGMENT FILED BY DEFENDANTS;
DENYING PLAINTIFF’S MOTION TO STRIKE
AND MOTION TO SHORTEN TIME AS MOOT
9
Defendants.
10
11
Defendants Hickman, Moua, Kay, White, Jacquez, Avila, Polk, Long, and Reynoso filed their
Northern District of California
United States District Court
12
second motion for summary judgment on August 7, 2014. (Dkt. No. 173.) The filing does not
13
comply with this Court’s Standing Order in Civil Cases at paragraph 9(a). The Standing Order does
14
not provide an exception to the Court’s pre-filing conference requirement for civil rights actions
15
where both plaintiff and defendants are represented. The motion for summary judgment is
16
STRICKEN on those grounds.
17
The Court further notes that the motion for summary judgment did not comply with this
18
Court’s Standing Order in Civil Cases at paragraph 9(c), requiring a separate statement of facts.
19
Counsel must correct this deficiency in any future filing. Finally, in any future letter requesting a
20
pre-filing conference, Defendants are directed to address why leave of Court to file an additional
21
summary judgment motion should be permitted. See Standing Order in Civil Cases, paragraph 9(b).
22
Based upon the foregoing, Plaintiff’s motions to strike the summary judgment motion and to
23
shorten time for hearing on that motion are DENIED as moot.
24
This Order terminates Dkt. Nos. 173, 178, and 179.
25
IT IS SO ORDERED.
